ARK Inc. ("we," "us," or "our") establishes this Privacy Policy (this "Policy") as set forth below regarding the handling of users' personal information in connection with the services provided on this website (the "Service").

"Personal information" means "personal information" as defined in the Act on the Protection of Personal Information (the "APPI"): information relating to a living individual that either can identify a specific individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in such information (including information that can be readily collated with other information and thereby identify a specific individual), or that contains an individual identification code.

Article 2 (Method of Collecting Personal Information)

In the course of inquiries, requests for materials, business discussions, job applications, and other communications with us, we may obtain, to the extent necessary to achieve the purposes of use, personal information such as name, company name, department, job title, address, telephone number, email address, the content of inquiries, information stated in job application documents, and other necessary personal information. In addition, in connection with the use of this website, we may obtain access information such as IP addresses, cookies, dates and times of access, pages viewed, device information, and other access information.

Article 3 (Purposes of Collecting and Using Personal Information)

The purposes for which we collect and use personal information are as follows:

  • To provide and operate our products, services, and business;
  • To respond to inquiries, consultations, and requests for materials from users (including identity verification);
  • To provide information regarding our products, services, business, events, exhibitions, seminars, and the like;
  • To carry out maintenance of this website, important notices, and other necessary communications;

Article 4 (Changes to the Purposes of Use)

Except where permitted by the APPI or other laws and regulations, we will not provide personal data to third parties without obtaining the prior consent of the individual. Cases permitted by laws and regulations include the following:

  • Where it is necessary for the protection of the life, body, or property of a person and it is difficult to obtain the consent of the individual;
  • Where it is especially necessary for improving public health or promoting the sound growth of children and it is difficult to obtain the consent of the individual; and
  • Where it is necessary to cooperate with a national government organ, a local government, or a person entrusted by either of them in executing affairs prescribed by laws and regulations, and obtaining the consent of the individual is likely to impede the execution of such affairs.

Notwithstanding the preceding paragraph, the recipient of the information will not be deemed a third party in the following cases:

  • Where we entrust all or part of the handling of personal data to the extent necessary to achieve the purposes of use;
  • Where personal data is provided in connection with a succession of business due to a merger or other reason; and
  • Where personal data is used jointly with a specific person, and we have, in advance, notified the individual of, or put into a state where the individual can readily know, that fact, the items of personal data to be used jointly, the scope of the joint users, the purposes of use by those who use the data, and the name of the person responsible for the management of such personal data.

Article 6 (Entrustment of the Handling of Personal Information)

We may entrust all or part of the handling of personal information to external contractors to the extent necessary to achieve the purposes of use. In such cases, we will appropriately select the contractors and exercise necessary and appropriate supervision over them.

Article 7 (Security Management of Personal Information)

We implement organizational, human, physical, and technical security control measures to prevent the leakage, loss, or damage of personal information and to otherwise appropriately manage personal information. Article 8 (Use of Cookies and Similar Technologies)

We may use cookies and similar technologies to understand and analyze the usage of this website and to improve its convenience. Such information does not, in itself, ordinarily contain information that identifies a specific individual. Users may disable cookies through their browser settings; however, doing so may prevent the use of some features of this website.

Article 9 (Disclosure of Retained Personal Data, etc.)

When an individual requests the disclosure of retained personal data or records of provision to third parties, we will, after verifying the individual's identity, disclose such information without delay in accordance with laws and regulations. However, where disclosure would fall under any of the following, we may decline to disclose all or part of the information, and if we decide not to disclose it, we will notify the individual to that effect without delay:

  • Where there is a risk of harming the life, body, property, or other rights or interests of the individual or a third party;
  • Where there is a risk of significantly impeding the proper conduct of our business; and
  • Where disclosure would otherwise violate laws and regulations.

If you wish to make a request for disclosure or the like, please contact the inquiry desk set forth in Article 13. We may ask you to submit necessary documents or information in order to confirm that the requester is the individual or the individual's authorized representative.

Article 10 (Correction, etc. of Retained Personal Data)

Where the content of an individual's retained personal data held by us is not factual, the individual may request that we correct, add to, or delete ("correction, etc.") such retained personal data in accordance with the procedures prescribed by us.

Upon receiving a request under the preceding paragraph, if we determine that it is necessary to comply with the request in accordance with laws and regulations, we will carry out the correction, etc. of the relevant retained personal data without delay.

When we have carried out a correction, etc., or have decided not to carry out a correction, etc., we will notify the individual to that effect without delay.

Article 11 (Cessation of Use, etc. of Retained Personal Data)

Where an individual requests the cessation of use or erasure ("cessation of use, etc.") of, or the cessation of provision to third parties of, their retained personal data on the grounds that it is being handled beyond the scope of the purposes of use, is being used by an improper method, was acquired by deception or other wrongful means, is no longer needed by us, has been subject to a serious leakage or the like, or that there is a risk of harm to the individual's rights or legitimate interests, or on similar grounds, we will conduct the necessary investigation without delay in accordance with laws and regulations.

Based on the results of the investigation in the preceding paragraph, if we determine that it is necessary to comply with the request, we will carry out the cessation of use, etc. of, or the cessation of provision to third parties of, the relevant retained personal data without delay.

When we have carried out a cessation of use, etc. or a cessation of provision to third parties, or have decided not to carry out such measures, we will notify the individual to that effect without delay.

Notwithstanding the preceding two paragraphs, where the cessation of use, etc. requires a large expense or is otherwise difficult to carry out, and where alternative measures necessary to protect the rights and interests of the individual can be taken, we will take such alternative measures.

Article 12 (Changes to This Privacy Policy)

Except as otherwise provided by laws and regulations, we may change this Policy as necessary. When we make a material change, we will make it known by posting it on this website or by other appropriate means.

Except as otherwise provided by us, the amended Privacy Policy will take effect from the time it is posted on this website.
